Since September 27, 2026, the new European rules against greenwashing have been applicable. Good news: the best defense is also the most effective one in video, the one that shows proof.<\/p>\n<h2 class=\"wp-block-heading\">What French law already says<\/h2>\n<p>No need to wait for Europe to be concerned. The French Consumer Code penalizes misleading commercial practices, including those about the environmental impact of a product or service. Penalties can reach a \u20ac300,000 fine, an amount that can be raised to 80% of the advertising expenditure. The French Climate and Resilience law also regulates the \u201ccarbon neutrality\u201d claim: the company must make its emissions, its reduction approach and the role of offsets accessible.<\/p>\n<h2 class=\"wp-block-heading\">What changes with Directive 2024\/825<\/h2>\n<p>This European directive (known as \u201cEmpowering Consumers\u201d) had to be transposed before March 27, 2026 and has applied since <strong>September 27, 2026<\/strong>. It targets commercial practices toward consumers and notably prohibits:<\/p>\n<ul class=\"wp-block-list\">\n<li><strong>generic claims<\/strong> (\u201ceco-friendly,\u201d \u201cenvironmentally friendly,\u201d \u201cgreen\u201d) without recognized environmental excellence;<\/li>\n<li><strong>sustainability labels<\/strong> not based on certification by a third party or an authority;<\/li>\n<li><strong>carbon neutrality claims<\/strong> based solely on offsetting;<\/li>\n<li><strong>future promises<\/strong> (\u201cneutral by 2040\u201d) without clear, measurable commitments verified by an independent expert.<\/li>\n<\/ul>\n<p>A note on France: according to the sources consulted in early October 2026, the transposition law (the \u201cDDADUE\u201d bill) had not been finalized, and the DGCCRF stated that it does not enforce on the basis of the directive until it is transposed. That doesn&rsquo;t permit you anything: existing French rules continue to apply.<\/p>\n<h2 class=\"wp-block-heading\">And the \u201cGreen Claims\u201d directive?<\/h2>\n<p>Don&rsquo;t confuse them. It is another Commission proposal (2023), which would have required environmental claims to be substantiated and verified before publication. It was never adopted: negotiations were halted in June 2025 and, according to the sources consulted, it remains on hold. <strong>It therefore does not apply today.<\/strong> Directive 2024\/825, on the other hand, is very much in force.<\/p>\n<h2 class=\"wp-block-heading\">On video: how to talk about your commitments without slipping up<\/h2>\n<figure class=\"wp-block-table\">\n<table>\n<thead>\n<tr>\n<th>Avoid<\/th>\n<th>Prefer<\/th>\n<\/tr>\n<\/thead>\n<tbody>\n<tr>\n<td>\u201cWe are a green company\u201d<\/td>\n<td>\u201cSince 2023, our workshop has run on renewable electricity\u201d (fictional example, to be replaced with a verifiable fact)<\/td>\n<\/tr>\n<tr>\n<td>A forest shot unrelated to your business<\/td>\n<td>Your places, your teams, your real approach<\/td>\n<\/tr>\n<tr>\n<td>\u201cCarbon neutral\u201d thanks to offsetting<\/td>\n<td>Measured reduction, offsetting presented as a complement<\/td>\n<\/tr>\n<tr>\n<td>An in-house logo that looks like a label<\/td>\n<td>An official label, with its name and scope<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<\/figure>\n<div class=\"tdp-tip\">\n<p><strong>Tip<\/strong> Before shooting, list each commitment statement with its proof: a figure, a date, a scope, a document. What has no proof doesn&rsquo;t go into the script. Keep this file with the film.<\/p>\n<\/div>\n<h2 class=\"wp-block-heading\">Five habits for sincere communication<\/h2>\n<ol class=\"wp-block-list\">\n<li><strong>Show actions<\/strong>, not intentions: a workshop, a process, a person explaining.<\/li>\n<li><strong>Specify the scope<\/strong>: a product, a site, an activity, not \u201cthe whole company\u201d if that isn&rsquo;t the case.<\/li>\n<li><strong>Give dated figures<\/strong> and the source, both spoken and as a subtitle.<\/li>\n<li><strong>Own what remains to be done<\/strong>: an honest approach inspires more trust than a perfect picture.<\/li>\n<li><strong>Let your teams speak<\/strong>: their words are more credible than a slogan, and they&rsquo;re also good for your employer brand.<\/li>\n<\/ol>\n<h2 class=\"wp-block-heading\">Going further<\/h2>\n<p>This article gives general guidance and does not replace legal advice.
